Terms of Service

These terms cover your use of Inbox Penny (“the service”, “we”, “us”). By creating an account you agree to them. If you are agreeing on behalf of a company, you confirm you may bind it.
The account
You need a working email address to register, and you are responsible for what happens under your account, including anything your team members do. Tell us promptly at hello@inboxpenny.com if you think someone else has access to it.
One person creates the organisation and becomes its owner. Owners can invite others; there is no charge per team member.
What you may send
This is the part that matters most to us, because sending abusive email damages the deliverability of every other customer on the platform.
You may only email people who agreed to hear from you. Specifically:
- No purchased, rented, scraped or harvested lists. If you did not collect the address yourself with the person’s consent, do not upload it.
- Every campaign carries an unsubscribe link and your postal address. We add both automatically and you may not remove, obscure or defeat them.
- Unsubscribes and spam complaints are permanent. The service stops mailing those contacts and you may not re-add them, re-import them, or move them back to a subscribed status to get around it.
- No impersonation. Do not send as a person, brand or organisation you are not authorised to represent.
- Nothing unlawful — phishing, malware, fraud, advance-fee schemes, or anything else illegal where you or your recipients are.
Bulk sending requires a verified sending address, either your own domain or a subdomain we provide. This is a technical requirement, not a formality: without it your mail cannot be signed and will not reliably arrive.
Review, limits and suspension
We apply automated controls to protect the platform. In plain terms:
- New accounts have a daily sending limit that rises as the account builds a clean record. Limits also apply while you send from a subdomain we provide.
- Campaigns may be held for review before sending. Reviews are usually quick; we will not always explain the specific reason, because doing so would tell people how to evade the checks.
- If your bounce or complaint rate climbs past safe thresholds, sending pauses automatically. This can happen part-way through a campaign.
- We may suspend or close an account that breaks the rules above, and we may do so without notice where the harm is immediate.
If we stop a send, you are not charged for mail that did not go out — see below.
Pricing and credit
There is no subscription. You load credit and draw it down as you send.
- $0.0010 per email ($1.00 per 1,000), charged exactly rather than rounded up.
- $1.00 minimum per campaign. A campaign with fewer than 1,000 recipients costs this much. Welcome emails and automation steps are charged at the plain per-email rate with no minimum.
- Minimum top-up $10.00.
- New accounts get 1,000 free emails, granted once. They are used before any credit, cannot be exchanged for money, and are not transferable.
Credit does not expire while your account is active. There is no time limit on spending it, no monthly minimum, and no charge for keeping a balance. Sending once a quarter costs you nothing in between.
Dormant accounts are the one exception, and it is not the same thing as expiry. If an account goes 24 months with no activity at all — no sign-in, no sending, no top-up — we may close it and any unused credit is forfeited, unless the law says otherwise. We will email you at least 60 days before that happens, and simply signing in during that period keeps the account open and the credit intact.
Prices are in US dollars and may change; a change never affects credit you have already bought. Credit is not a deposit, earns no interest, and is not refundable in cash except where the law requires it.
Refunds
- Mail we did not send is refunded to your credit balance automatically — for example if a send is stopped part-way by our safety controls.
- Emails that were actually sent are not refundable, including mail that bounced or that recipients ignored.
- If you believe you were charged in error, write to us within 60 days and we will look into it.
Your content and your contacts
Your campaigns, templates, images and contact data remain yours. You grant us only the permission needed to run the service: to store that content, send it to the recipients you choose, and show it back to you.
You are the controller of your contacts’ personal data and we are your processor. You are responsible for having a lawful basis to hold and email them. How we handle that data is described in our Privacy Policy.
Artificial intelligence features
Penny’s drafting, subject lines, rewrites, migration and report summaries are generated by a third-party AI model. Two things worth being explicit about:
- Your contacts are never sent to the model. We send campaign copy, your brand profile, and the names of your lists and custom fields — never contact records, email addresses or field values.
- AI output can be wrong. Read what it writes before you send it. You are responsible for the content of your campaigns, whoever drafted them.
AI features are included at no extra charge today. We may introduce fair-use limits with notice.
Availability
We work to keep the service running but do not promise a specific uptime. We depend on third parties — notably Amazon Web Services for email delivery — and an outage there can stop or delay sending. Scheduled sends fire on a timer and may run a few minutes late.
Ending the agreement
You may close your account at any time. We may end this agreement if you break these terms. When an account closes, unused credit is forfeited unless the law says otherwise, so spend it first. Export your contacts before you go — every list and segment has a CSV download.
Unsubscribe links in email you already sent keep working, and the records needed to honour them are retained, because recipients are entitled to opt out of mail that is already in their inbox.
Liability
The service is provided “as is”. To the extent the law allows, we are not liable for indirect or consequential loss, lost profits, or lost data, and our total liability is limited to what you paid us in the three months before the claim. Nothing here excludes liability that cannot lawfully be excluded.
You will cover us against claims arising from the email you send, including claims that you did not have permission to contact someone.
Changes
We may update these terms. For material changes we will email account owners before they take effect. Continuing to use the service afterwards means you accept the new version.
